RSA Public Protector Nkandla Report – Remedial Recommendations

Remedial action to be taken in terms of section 182(1)(c) of the constitution:
President Determine reasonable cost of measures that do not relate to security.
Pay a reasonable percentage of the cost,  Reprimand the Ministers involved,
Report to the National Assembly on his comments and actions on this report within 14 days.
Secretary to the Cabinet Update Cabinet Policy of 2003,  Assist Cabinet set clear standards on security measures
Periodically familiarise Cabinet with parameters for executive benefits and responsibilities
Department of Defence to create Standard Operating Procedures regulating the implementation of benefits
Minister of Police Expedite review of National Key Points Act to clarify applicability to presidential security privileges
No further security measures are installed
National Commissioner of the SAPS Identify officials involved, identify why prescripts were not complied with and decide on disciplinary action
Assist Minister of Police with contents and responsibilities under National Key Points Act and Cabinet Policy of 2003
Director-General of the DPW Identify officials involved, identify why prescripts were not complied with and decide on disciplinary action
Obtain advice from security consultant and estimate legitimate costs
Determine extent of over expenditure and obtain legal advice on the recovery
Determine SAPS and DOD liability for expenditure and recovery
Enter into a lease agreement with KwaZulu-Natal Ingonyama Trust Board in respect of the property occupied by the state
Relocate the park homes to another organ of state
Review the delegation of authority to Regional Offices
Train DPW staff
Comply with the provisions of GIAMA
Develop policy for  security measures
The Secretary for Defence Consolidate prescripts
Determine role of DOD Officials, in particular SAMHS, ascertain their remit and legal authority compliance.
MONITORING: President to submit report regarding the findings and remedial action within 14 days
Director General in Presidency to notify Public Protector and Cabinet
Accounting Officers of organs of state to take remedial action. Provide implementation plans by May 1, 2014.
Status reports within three months and final reports within six months
Office bearers to ensure compliance
